BSEACD NOTICE OF PUBLIC HEARING ON
PROPOSED RULES AND BYLAWS AMENDMENTS
The Barton Springs-Edwards Aquifer Conservation District Board of Directors will hold a rulemaking hearing at 12:00 p.m. on Friday, October 16, 2026, at the District office, 1124 Regal Row, Austin, Texas 78748.
The hearing concerns proposed amendments to the District Rules and Bylaws that would: establish Historical Trinity Production Permits for existing wells permitted for production from the Trinity Aquifer before a date certain, and Conditional Trinity Production Permits for applications for new permits or for applications to increase production by historic users, with such conditional permits being limited in part by the extent of applicant’s contiguous controlled surface acreage over the applicable Trinity Management Zone; limit new nonexempt Upper Trinity wells to domestic and livestock use; establish new well spacing requirements in the Trinity Management Zones; revise Limited Production Permit eligibility, volume, and well capacity; revise permit terms, renewals, and the classification of permit amendments; revise the criteria and procedures for acting on permit applications, including consideration of effects on registered exempt wells; revise provisions governing maximum withdrawals, Historic Use Status, drought management, variances, enforcement, civil penalties, and hearing procedures; revise definitions; establish specific rules for retail public utilities for the new contiguous controlled acreage and well spacing requirements; amend the well construction standards in Volume 2 of the Rules, including well location and property line setback requirements; and conform the Rules and Bylaws to laws enacted by the 89th Texas Legislature and to the District Management Plan.
A copy of the proposed amendments will be made available not less than 20 days prior to the date of the hearing, and may be reviewed on the District’s website (www.bseacd.org) or picked up at the District office during normal business hours. Following the hearing, the Board may take action to adopt some or all of the proposed amendments as proposed or with changes based on comments received or otherwise.
